Draft Law No. 7366 On Elections of People's Deputies of Ukraine (according to majority system) was registered (initiator -Petro Poroshenko Bloc MP Oleh Barna) on December 6. It was withdrawn on December 8, but it was not excluded from the proceeding with an appropriate indication of this in the database of bills of the website of the Verkhovna Rada, which contradicts the norm of part four of Article 104 of the Rules of Procedure.
Petro Poroshenko Bloc MP Oleh Barna together with 30 people's deputies submitted a draft law marked as revised, which is in the electronic database of parliament under the same number. This is also a violation of the Rules of Procedure, as it was registered on December 18 under a different number as a new bill.
The only difference between these bills is a different numbering of items in Article 51. Therefore, it is obvious that the second bill was introduced in order to demonstrate widespread support to the majoritarian system, increasing the number of initiators of the bill.
As an alternative to the Barna`s bill was registered 3 three law-drafts on December 20:
No 7366-1 About election of The People's Deputies of Ukraine (majority system) initiated by Chairperson of the deputy faction of Political party the All-Ukrainian Union “Batkivshchyna” Yulia Tymoshenko;
No 7366-2 About election of The People's Deputies of Ukraine initiated by Member of the deputy faction of Political party “People's Front” Leonid Yemets. The draft law 7366-2 was drafted with participation of Civic Network OPORA in collaboration with IFES;
No 7366-3 About election of The People's Deputies of Ukraine, initiated by non-affiliated People’s Deputy Viktor Chumak.
Probably, these bills will be put on a discussion for the adoption of one of them in the first reading. At the same time, further work on the electoral code will be postponed for a long time.
Perhaps, the President expects that the draft law on parliamentary elections on a majoritarian basis will be adopted in the first reading. Therefore, submission of bills with various modifications of the open list system is beneficial for creating the visibility of competition. It should be noted that the bill, which establishes the majority system, was signed by three parliamentary deputies (Member of the deputy faction of Oleh Liashko Radical Party Artem Vitko, Member of the deputy faction of Party “Petro Poroshenko Bloc” Serhiy Kunitsyn Kunitsin and Member of the deputy faction of Party “Petro Poroshenko Bloc” Yuriy Mamchur).
It is worth noting that the Constitution deals with elections to the Verkhovna Rada of Ukraine, while in the names of the bills presented by us, there are the words: "elections of people's deputies of Ukraine".
